An important part of the family law is the one that deals with the child support care. Child support is mandatory and could be of two types: direct, when the two parents are not separated and indirect, when parents are separated, or the child is living with grandparents, close relatives, court appointed foster parent or organization. In case of a divorce of the parents, the court orders the type of custody, the custodian and the way support will be provided for the child.
The basic principles are that both biological parents are obliged to provide support payments to their children even though they might not be living with them. Most jurisdictions and courts do not consider necessary for the parents to be married in order to be obliged to cover child support expenses if they are proved to be the biological parents. At the same time, regardless of the relationship between a custodian and a child, the biological parents are responsible for child support payment, and in case they are not willing to provide it the case should be referred to child support agency offices or lawyers and eventually to court. |
