Driving While Intoxicated Law is passed in all states to prevent citizens from diving with a blood alcohol or drug concentration (BAC) at or above the proscribed level.

The Blood Alcohol Concentration (BAC) of the driver has a prescribed level that ranges from 0.1 to 0.8 percent as it varies in the different states.

If it is ascertained the fact that BAC is above the legally permitted level there follows arrest, court conviction, administrative license suspension and possibly loss of vehicle if multiple offenses had been conducted by the same person.

Immediate administrative license suspension may be imposed prior to the trial court, if the driver fails or refuses to take the chemical test.

Court may order the offender to obtain treatment and/or operate their vehicle with an ignition locking system that analyzes the breath of the driver and disables the ignition if the driver has been drinking.

It is also prohibited by the Driving While Intoxicated Law that the driver or any other passenger in the car possesses an open container of alcohol.

Federal and state legislatures are recently enacting new drink driving laws that impose strict penalties on Driving Under The Influence offenders as well as try to provide some remedy for the divers.
